There’s a reason nearly all story pole installations require certification from a licensed land surveyor: only surveyors have the legal authority to determine precise heights and locations. General contractors are not permitted to solicit or provide land surveying services, certification letters, or layout and staking services. Offering such services without proper licensing violates California law and specific statutes outlined below.
Professional Land Surveyors’ Act (Business and Professions Code §§ 8700 – 8805):
8726. Definition of Land Surveying:
A person practices land surveying if they, in a public or private role, perform or offer any of the following:
- Determine, establish, or relocate alignments or elevations for fixed works within civil engineering practice as outlined in Section 6731.
- Measure the configuration or contour of the earth’s surface or the position of fixed objects, using principles of mathematics or photogrammetry.
- Determine information displayed on any map or document related to surveying activities.
- Represent themselves as a “land surveyor” or any related title suggesting land surveying expertise.
- Solicit or conduct land surveying work on behalf of themselves or others.
- Manage any business soliciting or performing land surveying work.
- Coordinate work with professional or technical consultants on land surveying activities authorized by this Act.
8751. Representing Oneself as Licensed
Only individuals holding a valid, unsuspended, and unrevoked license may use the title “professional land surveyor” or any variation thereof.
